Branding Use Cases
Can I use a clipart illustration as my logo?
Yes, if you purchase a Commercial or Extended Commercial license, you may use a clipart illustration as part of your logo, as long as the original asset is modified and not the dominant element of the logo.
However, you must disclaim the asset if registering for Trademark protection, and you may not enforce any rights on the asset itself.
Can I use an Asset to create a branding package for my own business that includes a logo, website, and other collateral?
Yes, this is permitted under the Commercial License. Keep in mind that a logo, a website graphic, and another collateral item like a brochure would be considered separate End Products. Under the Commercial License, you are permitted to create up to 5,000 End Products. If you use the licensed Asset to create more than 5,000 End Products within this branding package, please purchase an Extended Commercial License. Finally, the licensed Asset may not be redistributed or sub-licensed in any way that allows another End User to extract the Asset(s).
This use would not be permitted under the Personal License, since the End Use is for a business.
Can I turn clipart I purchase here into a logo then trademark it?
You may create a logo out of a licensed clipart illustration, but please note that the logo may not be trademarked unless:
- The licensed Asset is significantly altered and
- The licensed Asset is not the predominant element of the End Use.
The Licensed Asset must be disclaimed in any trademark registration. You may not register or trademark the Licensed Asset itself.
Can I use the Asset to create collateral for my brand (like tee shirts, hats, mugs, etc) and sell those End Products?
Yes, this is permitted under the Commercial License. Keep in mind that a tee shirt, hat, mug, etc, would each be considered separate End Products. Under the Commercial License, you are permitted to create up to 5,000 End Products, and those End Products are allowed a total of 5,000 sales. If you use the licensed Asset to create more than 5,000 End Products, or sell those End Products a total of more than 5,000 times, please purchase an Extended Commercial License (which allows you to create up to 250,000 End Products.)
Can I use the same Assets for more than one brand?
Yes, this is permitted under the Commercial License. Keep in mind that a logo, a website graphic, and another collateral item like a brochure would be considered separate End Products, whether they are within the same brand or across different brands. Under the Commercial License, you are permitted to create up to 5,000 End Products. If you use the licensed Asset to create more than 5,000 End Products, please purchase an Extended Commercial License.
Can I use an Asset to create branding for my client projects?
Yes, this is permitted under the Commercial License or Extended Commercial License.
- Commercial License: You may create multiple branding End Products for a client, such as a logo and a business card, for a total of up to 5,000 End Products. If the client asks you to create brand collateral (e.g. tee shirts, mugs, etc) with the licensed Assets, they may sell up to 5,000 total copies of a total of up to 5,000 End Products.
- Extended Commercial License: You may create multiple branding End Products for a client for a total of up to 250,000 End Products. If the client asks you to create brand collateral (e.g. tee shirts, mugs, etc) with the licensed Assets, they may sell up to 250,000 total copies of a total of up to 250,000 End Products.
If I create a brand for a client, may I transfer licensed Assets to them for to use for branding purposes?
If you’re using your licensed Asset in a new branding package for a client (which might include a logo, static website graphics, brochure, etc) you may sublicense the Asset to them on these conditions:
- The client is prohibited from extracting, reproducing or using the Licensed Asset in any way other than is necessary in order to exploit the End Use that you provided to the client.
- You should also make sure that the client understands the terms of the license, and that they must continue to abide by the terms of the license for that Asset.
- If they wish to use the Asset for separate unrelated End Uses, they should purchase a license separately.
